Young man loses arm in machine accident

A young employee had to have his left arm amputated after it was trapped in a piece of workplace machinery at Natural World Products Ltd. in Co. Armagh, Northern Ireland.

While conducting his daily check on 29 June 2010 the employee had noticed a piece of wood had been caught under the conveyor of the screening machine and suffered severe injuries to his arm when he attempted to remove it.

The machine was unguarded and a HSENI investigation has determined that the original guard had been tampered with and reduced in size in order to allow maintenance staff access to internal machine parts while it was running.

The HSENI inspector, Kevin Campbell warned, "It is essential that companies identify and address hazards within the workplace. Measures must be taken to control and limit access to dangerous moving parts of machines. Companies must ensure that maintenance teams are trained in identifying missing or defective guards and the importance of replacing guards that are removed during maintenance operations."

The company responded that since the accident they have replaced the guard and also that the injured employee has returned to work and had work equipment specially modified for his needs.

Inspector Campbell stated however, "The company should have either left the guard on, or adapted and refitted it so that it covered all the dangerous moving parts of the machine."

On 7 October Natural World Products Ltd. were fined £5000 by the Newry Crown Court after pleading guilty to Article 4 of the Health and Safety at Work Order and failing in their responsibility to provide a safe working environment.

Unregistered gas fitter fined after putting lives at risk Date:

A gas fitter has been fined after he misled a customer into believing he was legally registered and then carried out work that put lives at risk.

Janusz Mazur, 34, of Sunnyhill Road, Lambeth, was self-employed when he carried out work at a flat in Ritherdon Road, Tooting Bec, installing a new boiler and pipework.

It is a legal requirement for any gas engineering business or self-employed gas engineer carrying out domestic or commercial gas work to be registered under the Gas Safety (Installation and Use) Regulations 1998.

Investigations by the Health and Safety Executive (HSE) found the work carried out was sub-standard. The Gas Safe Register could not confirm the safe operation of the gas pipe work and gas boiler. Gas safety defects with the potential to cause harm were present on installation work, which could have put lives at risk. It was also found that Mr Mazur had falsely pretended to be a Gas Safe registered engineer but was not and never had been.

HSE inspector Saif Deen said:

"There is no excuse for illegally carrying out work on gas appliances and to falsely claim Gas Safe Register membership in order to defraud customers is a very serious offence.

"It is illegal for any unregistered person to carry out such work. When unqualified workers try to bypass the law in this way they are not only putting themselves at risk of prosecution, a large fine and a lengthy time in prison – they are also putting their customers’ lives at risk.

"The householder in this case has suffered a great deal of stress and feared for her safety as a result of Mr Mazur’s actions.

"Working with gas appliances is difficult, specialised and potentially dangerous. Only qualified and registered engineers should attempt it. HSE will not hesitate to prosecute those who break the law in this way."

Janusz Mazur, Sunnyhill Road, Lambeth, was found guilty of breaching Regulations 3(3) and 3(7) of the Gas Safety (Installation & Use) Regulations 1998 and was fined £600 with £1,994 costs.

"We work closely with the HSE to investigate unregistered gas fitters and the prosecution of Janusz Mazur comes as welcome news to us all.

"Gas fitters working unregistered like Janusz Mazur are far more common than you think – we estimate they’re doing 250,000 illegal jobs each year, causing fires, explosions, gas leaks, carbon monoxide poisoning and leaving people out of pocket.

"All gas engineers have to be Gas Safe registered – it’s the law. Our message to everyone is clear – check the engineer’s Gas Safe Register ID card before letting them work on gas."

Builder given community service for unsafe gas work

A self-employed Lockerbie builder has been given a Community Service Order after he carried out an unsafe gas installation.

Kevin Graham was carrying out general building and plastering work at Greenbank Cottage on the outskirts of Ecclefechan during the Spring and Summer of 2009, when he offered to install a gas fire that the owner had bought saying it was relatively easy to do and he had done so in his own home. Mr Graham was not a Gas Safe registered engineer.

After Mr Graham had installed the gas fire, it was used regularly until January 2010, when the owner of Greenbank Cottage called a local plumbing and heating company to ask them to look at the fire as he had noticed a smell of gas.

A competent and qualified gas engineer with the firm carried out a visual check of the fire and also noticed a smell of LPG. He identified a gas leak at the back of the fire and immediately prohibited its use. The company then raised their concerns about the fire to the Health and Safety Executive (HSE).

On 19 February 2010, a Gas Safe Register Inspector visited the property and found that the fitting connecting the gas supply to the fire was loose, causing LPG to leak. The 11m supply pipe had also been unsafely installed, as it had been routed around the property without any support, putting stress on the soldered joints of the pipe, which also would have led to gas leaking.

The investigation also found that the flue from the fire wasn't functioning properly so there was a risk that smoke and fumes could re-enter the property when the fire was in use.

Mr Graham had also left unsealed gaps within the builders opening of the fire and used wood and expanding foam within the builders opening, which had a very high probability of causing a fire. He also left the gas fire unsecured to the fire surround, leaving it unstable and making it possible for fumes to escape further.

Within days of the Gas Safe Register inspection, the HSE issued a Prohibition Notice against Kevin Graham stopping him from carrying out any work on or to gas fittings or service pipe work.

At Dumfries Sheriff Court Kevin Graham, was given a 240 hours Community Service Order after pleading guilty at an earlier hearing to breaching the Gas Safety (installation and use) regulations 1998 regulation 3(3) and 26(1) and section 3(2) of the Health and Safety at Work etc Act 1974.

After the hearing, HSE Inspector Russell Berry said: "In carrying out this work while not registered and competent to do so, Mr Graham put those living at Greenbank Cottage at risk not only from carbon monoxide poisoning but also from fire and explosion.

"On average, 20 people each year die from carbon monoxide poisoning caused by poorly installed, maintained or ventilated gas appliances and flues. Many more become seriously ill and in extreme cases, prolonged exposure to carbon monoxide can cause paralysis and brain damage. In this case, the occupiers of this house were very lucky indeed not to have suffered any medical ill effects. Any business or sole trader who carries out work on any domestic or commercial gas appliances without being on the Gas Safe Register is breaking the law and potentially putting lives at risk."

Paul Johnston, chief executive of Gas Safe Register said: "We work closely with the HSE to investigate unregistered gas fitters and welcome successful prosecutions such as this. Unregistered gas fitters can present a real risk, not only in terms of potentially leaving gas appliances in an unsafe condition which could cause carbon monoxide poisoning, fire, gas leaks or even potentially explosions, but also leaving people out of pocket if they have to have the work put right."

A brewing giant says it has invested more than £1million in improving safety after being fined £45,000 for two separate health and safety violations which saw a total of four workmen suffering injuries including severe burns and serious fractures.

The two incidents within six weeks of each other at the firm’s Station Street site, three contractors suffered chemical burns when 6,000 litres of caustic soda erupted from a faulty valve and a delivery driver was also hit by a forklift truck while on site.

All four men were left with a number of injuries and one has still not been able to return to work as a result, despite the fact the incident happened three years ago.

A spokesman for the firm said: “This week Molson Coors admitted that in 2008 there were two accidents at the company’s Burton brewery that were, in part, the fault of the company.

“These accidents are a matter of great regret for us. Since these incidents, however, we have taken a series of steps, which have helped ensure that health and safety is the priority it should always be, from shop floor to the board.

“In the last two years — 2009 and 2010 — Molson Coors has invested in excess of £1 million in improving safety across our breweries in the UK.

“In addition to changes to the physical environment of our sites across the UK, we have concentrated on changing the management processes that contributed to the accidents.

“A cultural shift has also been created so that health and safety issues are taken seriously and potential problems reported as soon as they arise.

“Today, nearly a third of our staff are ‘Safety Observers’ — volunteers who are there to help prevent accidents happening in future.

“These root and branch changes at Molson Coors, coupled with significant investment, have already had a dramatic impact on injuries at our sites and will help reduce risk still further.”

In addition to the combined fines of £45,000, the firm was also ordered to pay a total of £76, 716 in court costs.

Let’s talk gas safety

At this time of year and with the recent cold weather, people will want to keep warm at home. But to keep safe as well as warm, it is important to make sure that your central heating boiler and all of your gas appliances are working properly.

Gas Safe Register replaced CORGI Gas Registration on 1 April 2009 and is the only official list of gas engineers who are legally allowed to do work on your gas boiler, gas cooker or gas fire. The list is there to help protect you from unsafe gas work and all gas engineers have to be Gas Safe registered by law.

HSE advises that you should have any gas appliances in your home checked once a year by a Gas Safe registered engineer. Annual servicing not only helps keep your heating and hot water working properly, it helps keep you safe.

All Gas Safe registered engineers carry an ID card so they can show you they are Gas Safe registered when they turn up at your front door – if they don’t show you then don’t be afraid to ask to see it. Waste firm fined £60,000 after worker loses arm

A waste recycling firm has been fined £60,000 after a worker lost part of his arm in an industrial incident in Basildon, Essex, the Health and Safety Executive has said.

The HSE said Daniel Ali, 35, a process operator at Coolrec UK, was picking plastic off a recycling line that handled old computer monitors and television sets when he bent down to clear some wire from the ground and his glove became caught in an unguarded conveyor.

He was trapped for about 45 minutes until emergency services freed him, but doctors could not save his arm and had to amputate it.

In a Health and Safety Executive (HSE) prosecution, Basildon magistrates fined Dutch parent company Coolrec Group £60,000 and ordered it to pay £22,000 costs after it admitted breaching health and safety regulations.

The HSE said the 2008 incident had been “completely avoidable”, adding: “Coolrec Group could and should have ensured the conveyor belts on the recycling line were properly guarded.”Health and SafetyHealth and Safety

A CHINESE restaurant in Walton was fined for breaking health and safety regulations on Wednesday, February 9, at Staines Magistrates Court.

Manager, Wei Zhai, of Summer Palace, in Bridge Street, admitted the offences on behalf on the company Kenzola when Elmbridge Borough Council prosecuted the business.

Ms Zhai, admitted failing to ensure the health, safety and welfare at work of the company’s employees, by allowing the kitchen floor to be in a dangerously slippery condition, so presenting a risk of injury to employees from slip accidents.

The company was fined a total of £1,500, and was ordered to pay the council’s costs of £1,168.29.

The court heard that officers from the council’s environmental health and licensing division had visited the premises on a number of occasions between May 2008 and March 2010, and despite repeated advice on how the problem could be remedied, found the floor in the kitchen to be slippery and presenting a serious and unacceptably high risk of injury to employees.

Councillor Glenn Dearlove, portfolio holder for environment and economy, said after the case: "The council takes a proactive approach to helping businesses in the borough to comply with health and safety at work provisions, as is clear from the repeated advice and guidance offered by officers in this case.

“However, where there is a clear, repeated and significant breach of the law, as in this case - despite the resolution of the problem being relatively easy to achieve - which can ultimately put employees at risk, we will take the necessary action to ensure the risk of injury from slip or trip accidents is minimised.”

The manager of the Summer Palace was unavailable for comment before the Herald and News went to press.

According to the council the effects of slips, trips and falls at work in the catering and hospitality industry both for those involved, their families and the industries they work in, costs £800m a year across the UK.

Clampdown on safety on construction sites

A clampdown on unsafe working practices in construction sites has begun, to try and cut the number of injuries suffered by workers.

The Health and Safety executive has announced that over the next month they will be launching an intensive inspection campaign. Starting today – Valentine’s Day – they will be making unannounced visits to construction sites across the country.

During the inspections, they will be checking on numerous things, including if safe methods are used for working at height. They will also be checking that equipment is well maintained, and that the site is well organised. This year emphasis will be put on overseeing that the risk of potentially working with asbestos is managed correctly.

The HSE run a similar inspection drive every year. Last year they visited 2014 sites and issued a total of 350 prohibition notices. These notices stop work being carried out until the serious safety issue in question has been addressed.

According to official figures, in 2009/2010 there were 42 deaths of construction employees in workplace accidents. During the same period, 3.3 million working days were lost due to serious work accidents and work-related ill health.

A spokesperson for the HSE stated that a lax attitude to health and safety is not acceptable, and that most accidents are entirely preventable

The Regulatory Reform (Fire Safety) Order 2005 (FSO) came into effect in October 2006 and replaced over 70 pieces of fire safety law.
The　FSO applies to all non-domestic premises in England and Wales, including the common parts of blocks of flats　and houses in multiple occupation. The law applies to you if you are:
· responsible for business premises
· an employer or self-employed with business premises
· responsible for a part of a dwelling where that part is solely used for business purposes
· a　charity or voluntary organisation
· a　contractor with a degree of control over any premises
· providing accommodation for paying guests (B&B`s etc...)

Under the FSO, the responsible person must carry out a fire safety risk assessment and implement and maintain a fire management plan.

Prisoner to sue over rodent bite.

A judge in New York has allowed a man to proceed with a lawsuit claiming a rodent bit him on the penis while he was being held in prison. District Judge Arthur Spatt denied Nassau County's motion to dismiss Peter Solomon's lawsuit, which claims officials did not take adequate steps to ensure the safety of inmates at the jail in East Meadow.
Solomon, who was jailed on a charge of menacing his wife in 2007, claims he was bitten by a rat or "similar rodent".
His 2008 lawsuit claimed the county was indifferent to rodent complaints from prisoners.
The county contended there was no evidence of rodents, but the judge said Solomon raised enough issues about pest control for the suit to proceed.
The ruling was reported in the New York Law Journal on Thursday.

Punch Taverns hit with fine

A brewery has been ordered to pay £27,481 in fines and costs after pleading guilty to serious breaches of fire safety legislation following a prosecution brought by the London Fire Brigade.
Punch Taverns PLC admitted guilt on seven contraventions of the Regulatory Reform (Fire Safety) Order 2005. Sentencing occurred on Thursday 6 January 2011 at Thames Magistrates Court.
The Milestone Public House on Mile End Road, E3 4PH was inspected by fire officers on 7 July 2008. The officers found a number of fire safety failings in both the Public House and the first floor, which was being used as a house of multiple occupation, including inadequate maintenance of the fire alarm and emergency lighting. An enforcement notice was issued and time was given for them to comply.
Officers returned on the 14 November 2008 and found a number of faults still hadn’t been fixed.
The Regulatory Reform (Fire Safety) Order places a duty on the 'responsible person' for the premises (the person who controls the premises e.g. a owner /landlord/employer) to carry out a fire risk assessment, take appropriate measures to minimise the risk of fire and implement general fire precautions to protect people in the premises if a fire occurs. The assessment and the fire precautions must be kept under review by the ‘responsible person’.
Assistant Commissioner for fire safety regulation Steve Turek said: “London Fire Brigade will continue to take action when businesses, large or small, do not take their fire safety responsibilities seriously. Failure to comply with the law can, as this case has shown, result in a prosecution.”

UK-based bakery fined

A UK-based bakery has been fined after a worker’s fingers were crushed in the rollers of a dough sheeter machine.

The firm, Tower Bakery Limited of Shore Road, Perth, Scotland was ordered to pay £4000 for the March 2008 incident.
The court heard that the individual involved worked as the confectionery manager at the factory and suffered serious crush injuries to his right hand, including three 5cm puncture wounds to his fingers.
No training
At Perth Sheriff Court, Tower Bakery pleaded guilty to a breach of Section 2 (1) of the Health and Safety at Work Act 1974, in that it failed to assess the risks to workers when cleaning the dough sheeter and that it failed to give employees sufficient training, supervision, information and instruction for the task of cleaning the machine.
Commenting after the case, the UK’s Health and Safety Executive (HSE) Inspector Rachel Doyle, said: "Tower Bakery had left the injured person to his own devices when cleaning the dough sheeter. A simple risk assessment would have shown that there was an obvious risk whilst the rollers were in operation, and allowed action to be taken to prevent access.”
“Employers must realise that it is unacceptable to not provide training and supervision on an ongoing basis," she added.

According to an investigation by HSE, Tower Bakery Limited had never carried out a risk assessment for the process of cleaning the dough sheeter.
The worker had copied the process he had seen other employees use and had not been made aware that power to the machine could be isolated to allow it to be cleaned.

Power construction engineer David Askew, 52, from Braintree, Essex, suffered

Tesco sorry for baby mice in crisps

Liz Wray said she was shocked to see half a dozen pink mice emerge from multipacks of crisps at a new Tesco store in Aston, Birmingham.
The mother of one said she was also horrified the store was not shut down straight away, but was still open several hours later as pest control staff arrived.
Tesco apologised for the "upsetting" discovery and said it was confident the incident was isolated.
A spokesman said: "This was clearly an upsetting discovery for our customer, for which we are very sorry.
"Pest control experts have been in the store over the weekend checking it from top to bottom and we're confident this was an isolated incident.
"The cleanliness of our stores is a priority for all our staff."
Ms Wray told the Birmingham Mail she was with a work colleague when they made the discovery.
"Suddenly these tiny pink things appeared from the multipacks and were lying in front of us," she told the paper.
"They were repulsive and made me feel revolting. There were half a dozen of them crawling out of different holes in the crisps and we couldn't believe our eyes."
